In the event of a total loss of a shipment after risk passes from Seller to Buyer as defined in TITLE AND RISK and before the completion of the operations described in WEIGHING AND SAMPLING,provisional payment shall be made as set out in PAYMENT and final settlement shall be made as soon as all necessary details are available based on the bill of lading weight,assays as per Seller’s provisional assay certificate and otherwise in accordance with the terms of this contract.The insurance settlement shall accrue to Buyer.For the purpose of this clause the estimated date of arrival of the carrying vessel at the discharge port as notified at the time of departure from the loading port shall be considered as the vessel’s arrival date.
