It is important for all business owners to know and understand the laws that affect their businesses. It is equally important to comply with those laws. Ignorance of the laws has never been a valid excuse in any Court of Law, and it never will be. As a business owner, it is your responsibility to know what laws affect your business.
Since every business, in every state, in every country is different, the laws that affect your business may be different than the laws that affect other businesses. For that reason, it is impossible to give an account of all laws that affect all businesses. You will need to find out what the laws are that affect your business, however, these tips will help you know what questions to ask in regards to certain laws.

Just as tax laws are complicated, contract laws are complicated as well. Protect yourself and your interests by hiring a business lawyer to help you comply with these laws, and to use these laws to protect yourself and your business.
Consumer Protection Laws:
These laws are designed to protect consumers from fraud and from defective or dangerous products. A business lawyer can usually help you in this area as well.
Internet Laws:
If you conduct any portion of your business on the Internet, you must comply with specific laws. The biggest issue facing business owners conducting business on the Internet is the new SPAM laws.

On October 17, 2005, the most significant revision to U.S. bankruptcy law in a generation took effect. If you followed the media’s coverage of the new law before it became effective, you could easily have assumed that the changes were aimed only at consumers filing bankruptcy to get rid of credit card debt. However, the surprising news is that the new bankruptcy law changes also contained a host of provisions that will affect businesses. Many bankruptcy lawyers (this one included) think the law will make it more difficult for some businesses to reorganize, which could end up reducing recoveries for unsecured creditors. Uniform defamation laws to affect businesses
Businesses, legal firms and media organisations have been eagerly awaiting the release of the latest Deformation Act 2005 (SA).
This is not surprising given that the focus of this type of legislation is to maintain a delicate balance between protecting freedom of expression and personal reputation.
The Act achieves uniformity across defamation laws throughout Australia, a task that has been unsuccessfully attempted since 1979.
Similar legislation implemented in every State has finally removed major discrepancies that have been complicating defamation laws for decades.
Businesses should be aware of the changes to defamation law in Australia
For South Australia, many of the new laws are simply a re-statement of the current common law position. For example, the defences of truth, absolute privilege for certain parliamentary and court proceedings and innocent dissemination may still protect those facing defamation claims.
However one major change that businesses need to be acutely aware of is the new limitation on a corporation's right to sue for defamation.
Under the new legislation, only those companies that are operated on a not-for-profit basis, or stand alone companies with fewer than 10 employees, can sue for defamation.
Larger companies, and even public bodies, are prevented from pursuing such a path unless it is an individual of a company suing for damage done directly to the individual.
Consequently, companies will need to consider careful public relations strategies to reduce the impact of publications for which a right of defamation may now no longer lie.
Legislators were also concerned with promoting the resolution of disputes without the need for litigation.
As such, the Act details guidelines on how a publisher may provide an offer to make amends to a defamed person.
If the offer is not accepted, but it is one which has been made within an appropriate time period and is reasonable, then this can be used as a defence to the defamation claim.
Another modification to previous defamation law is the effect of an apology on liability for defamation.
Previously, care had to be taken in order to avoid any admission of liability.
However the new legislation makes it clear that any apology is not an admission of fault and cannot be used as evidence in civil proceedings.
Damages is another area that has been reformed, with non-economic loss being limited to $250,000 and abolition of the Court’s right to award exemplary or punitive damages, which are damages often aimed at punishing the one responsible for the defamatory publication.
Only time will tell whether these new uniform defamation laws provide stability in an area often described as complex and ineffectual.
At least there is comfort in the fact that if there is any balance that can be achieved, it will be on a national level…finally.
