(12) Inspection and Claim :The Buyers shall have the right to apply an independent Survey Co.for inspection after discharge of the goods at the destination.Should the quality and / or quantity /
weight be found not in comformity with the contract or invoice the Buyers shall be entitled to lodge claim with the Sellers on the basis of Survey Report,within 30 days after discharge of
the goods at the port of destination,with the exception.however,of those claims for which the shipping company and / or the insurance company are to be held responsible.
All expenses of inspection should be borne by the Buyer's cost.
(13) Liquidated Damages :In case the Seller fails to make delivery of the Contract commodity within the shipping date stipulated in the relative letter of credit due to the reasons attributable to
the Seller,The buyer shall impose on the Seller liquidated damages for late shipment in the amount equivalent to one tenth of one percent (0.1%) of the Contract amount for each day delayed.
If partial shipment is allowed,0.1% of the amount of the delayed portion for each day shall be imposed.Notwithstanding the above,the liquidated damages shall not exceed
five(5) percent of the Contract amount and/or the amount of delayed partial shipment respectively
