摘要 占有制度是一项古老的民法制度,无论是从其法律性质上的权利说和事实说的争议,还是体素和心素构成要件上的争议,都造就了理论上对占有的不同分类.而在我国现行物权占有制度的框架下,立法并非完全采纳了这形形色色的占有分类种类.故对于我国立法的取舍合理与否以及对物权占有制度的完善与否,很大程度上与占有分类有关.文章通过将直接占有和间接占有,善意占有和恶意占有,有权占有和无权占有,自己占有和他主占有,自主占有和辅助占有进行分类并逐一分析,从而窥探出我国物权法中占有制度的缺陷和不足.并且通过时效取得制度和先占制度这两块内容,尝试着提出对占有制度的完善建议,探讨在我国物权法框架下占有制度的得与失.
