摘要
专利权作为一种法定授权,需要专利申请人向国务院专利行政部门提出申请并经过严格的依法审批才能获得.对于不同的专利类型,我国采取了不同的审查制度,包括适用于发明专利的“早期公开,延迟审查”制度和适用于实用新型及外观设计的“形式审查”制度.本文主要阐述了我国专利审批过程中所涉及的各种制度和规范,并在参考了欧洲专利的审批制度后,针对我国专利审查制度中存在的问题,提出了解决的方案,即通过建立专利法院和知识产权法院,从根本上杜绝循环诉讼中的权利冲突问题；颁布相关的司法解释来进一步完善实用新型专利评价报告制度的具体规定等等.在文中我个人初步提出了构建专利法院和知识产权法院的设想以及对适用新型专利评价报告制度的不足之处提出的改革方案,希望以此来完善我国的专利审查制度.

As a statutory right,the applicant for a patent license to the administrative department for patent under the state council for examination and approval according to law and through the strict to obtain.For different types of patent,China adopted different censoring system,including applicable to the invention patent examination,delay in early "public" system and applies to utility and appearance design of "form" system review.This article mainly expounds the Chinese patent approval process involves various rules and procedures,and the European patent in reference to the examination and approval system in patent examination system,the problems and proposes the solution through the establishment of patent,intellectual property rights and court,the court of fundamentally eliminate cycle from right conflicts,Promulgated by the relevant judicial explanation to further improve the patent for utility model evaluation report system of the specific provisions,etc.In this I put forward building patent court and intellectual property to the court for new ideas and patent assessment report system of the shortcomings of the proposed reforms,hope to improve China's patent examination system.
