罪的情况下,在法律上应推定其无罪,犯罪嫌疑人、被告人的诉讼地位、诉讼权利皆由此决定.无罪推定原则是专制擅断走向民主公正、愚昧落后走向科学进步、尊重人权、体现社会主义的一个标志,虽然我国修正后的刑事诉讼法对无罪推定有了规定,但新的《刑事诉讼法》在实质上并没有确立完全意义上的无罪推定原则.为此笔者从无罪推定原则的概念和历史渊源、无罪推定原则在我国刑事诉讼法中的具体体现、我国的无罪推定原则存在的问题及完善三个方面进行论述.
