我国老龄化进程不断加快,老年人犯罪日益成为社会的主要问题.老年人由于自身各种因素的限制,属于死刑适用对象中的特殊主体.中国从古至今以及外国立法中对老年人死刑以及刑事责任问题都有规定,《中华人民共和国刑法修正案（八）》于2011年2月25日经十一届全国人大常委会第十九次会议表决通过,并于2011年5月1日生效.此次修订对老年人适用死刑问题有了新的突破,此规定的出台填补了我国关于老年人从宽处罚的立法空白,同时也严格限制了对七十五周岁以上老年人的死刑适用条件.这条规定对老年人死刑适用问题有重要影响.国内外刑事立法和理论往往对未成年人和孕妇适用死刑问题关注较多,对老年人适用死刑的规定涉及较少.老年人如何适用死刑不仅是一个重要的理论问题,更是一个重大的实践课题,本文拟以刑法修正案（八）的出台为引子,对老年人如何适用死刑问题做一次深入考察和思考.我国《刑法修正案八》增加对于老年人死刑的免除条款,足以见得社会以及国家对于老年人的重视.在对老年人犯罪适用刑罚的时候,在综合考虑老年人自身的犯罪原因、特征、刑事责任能力、国际社会的通行做法、刑罚的目的、刑事政策的作用以及社会反映等诸多因素的同时,通过梳理从1979年至今我国控制死刑的发展脉络,结合我国对于死刑制度在罪名的减少以及死刑适用的限制,分析老年人犯罪的现状、人口比例、适用死刑等问题,并提出对老年人严格死刑适用的建议和对策,可以为我国刑法控制死刑增添力量.
