In the event of Non-Performance by the Seller in accordance with Clause 12 and Clause 17 and of non-payment by Seller of any damages pursuant contingent and incidental thereto and regardless any of this be for whatever reason other than what the Buyer may determine is a good faith dispute,then the Payment Guarantee may be called in by the BUYER.Following any such call,Seller will instruct its bank to issue a new PB within a period of THREE INTERNATIONAL BANKING DAYS,having the same tenor as the previous one.Until such new PB has been issued,all payments due from the Buyer to Seller will be suspended.
